本利用規約（以下「本規約」）は、Nocta - AI Diary（以下「本アプリ」）の利用条件を定めるものです。本アプリをご利用いただくことで、本規約に同意したものとみなします。
1. サービスの概要
本アプリは、写真と感情をもとにAIが日記を自動生成するライフスタイルアプリです。
2. AI生成コンテンツについて
- 本アプリの日記はAI（Google Gemini または Anthropic Claude）によって自動生成されます
- AI生成コンテンツは創作的な表現であり、事実の正確性を保証するものではありません
- 生成された日記はユーザーが自由に編集・利用できます
3. 利用上の注意
ユーザーは以下の行為を行わないものとします。
- 違法行為や公序良俗に反する目的での利用
- 他者の権利を侵害するコンテンツの入力
- 本アプリのリバースエンジニアリング、改ざん、不正アクセス
- 自動化ツールによる大量リクエストの送信
- 本アプリの運営を妨害する行為
4. 利用制限
- 無料プランでは月10回までの日記生成、1日2枚までの写真に制限されています
- 利用制限の内容はプランや時期によって変更される場合があります
5. 知的財産権
- 本アプリのデザイン、コード、コンテンツに関する知的財産権は当社に帰属します
- ユーザーが撮影した写真および入力したメモはユーザーに帰属します
- AIによって生成された日記はユーザーが自由に利用できます
6. 免責事項
- 本アプリは「現状のまま」提供されます
- サービスの中断、データの損失、AI応答の不正確さについて、当社は一切の責任を負いません
- 端末の故障やアプリのアンインストールによるデータ消失について、当社は責任を負いません
- 第三者サービス（Gemini API、Claude API、Supabase 等）の障害に起因する問題について、当社は責任を負いません
7. サービスの変更・終了
当社は、事前の通知なく本アプリの内容変更、機能の追加・削除、サービスの一時停止または終了を行う場合があります。
8. 利用規約の変更
本規約は、必要に応じて変更されることがあります。変更があった場合は、本ページの最終更新日を更新します。重大な変更がある場合は、アプリ内で通知する場合があります。
9. 準拠法・管轄
本規約は日本法に準拠し、紛争が生じた場合は東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service (the “Terms”) govern your use of Nocta - AI Diary (the “App”). By using the App, you agree to these Terms.
1. Service Overview
The App is a lifestyle application that automatically generates diary entries from photos and emotions using AI.
2. AI-Generated Content
- Diary entries in the App are automatically generated by AI (Google Gemini or Anthropic Claude)
- AI-generated content is creative expression and does not guarantee factual accuracy
- Generated diary entries may be freely edited and used by users
3. Acceptable Use
Users shall not:
- Use the App for illegal purposes or purposes contrary to public order
- Input content that infringes on the rights of others
- Reverse-engineer, tamper with, or gain unauthorized access to the App
- Send mass requests using automated tools
- Interfere with the operation of the App
4. Usage Limitations
- The free plan is limited to 10 diary generations per month and 2 photos per day
- Usage limitations may change depending on the plan or time period
5. Intellectual Property
- Intellectual property rights for the App’s design, code, and content belong to us
- Photos taken and notes entered by users belong to the users
- AI-generated diary entries may be freely used by users
6. Disclaimer
- The App is provided “as is”
- We are not liable for service interruptions, data loss, or inaccuracies in AI responses
- We are not responsible for data loss due to device failure or app uninstallation
- We are not liable for issues caused by third-party service failures (Gemini API, Claude API, Supabase, etc.)
7. Service Changes and Termination
We may modify, add or remove features, suspend, or terminate the App without prior notice.
8. Changes to These Terms
These Terms may be updated as needed. Changes will be reflected by updating the “Last Updated” date. Significant changes may be communicated through in-app notifications.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
